General Terms and Conditions (GTC)

Booking Conditions for Holiday Apartments and Houses

1. Booking and Conclusion of Contract

With the booking confirmation, a binding rental agreement is concluded between the guest and the intermediary agency HolAp srl or the respective property owner. HolAp srl acts as an intermediary in the name and on behalf of the owner or service provider and sends the guest a written booking confirmation.
The booking becomes binding as soon as it has been confirmed in writing (by email or via a booking portal).
If the booking confirmation/invoice differs from the online listing or other publications, the guest acknowledges the conclusion of the contract according to the booking confirmation by making the payment.
Special requests or verbal agreements are only binding if confirmed in writing by HolAp srl.

2. Prices / Additional Costs / Booking Fee

Published seasonal prices are per week or per stay for the entire rental property.
As a rule, additional costs (e.g. final cleaning, laundry, and booking fee) are included unless otherwise stated in the property description.
The details stated in the booking confirmation are always decisive.

3. Payment Terms

A deposit of 30% of the total price is due no later than 10 days after receipt of the booking confirmation.
The remaining balance must be paid no later than 30 days before arrival.
For bookings made within 30 days before arrival, the full amount is due immediately upon receipt of the booking confirmation.
If payment is not made on time, HolAp srl is entitled to withdraw from the contract after an unsuccessful reminder. In this case, the cancellation conditions under section 12 apply.
After receipt of the full payment, but not earlier than 28 days before the start of the stay, the guest will receive the stay voucher.

4. Number of Persons

The rental property may only be occupied by the maximum number of persons indicated in the booking confirmation (including children).
The service provider/key holder has the right to refuse additional persons.

5. Pets

If indicated in the booking confirmation, one pet may be brought (in some cases subject to an additional fee).
Additional pets are not permitted without written confirmation.

6. Rental Period and Arrival/Departure

The minimum stay is 5 nights, or at least 3 nights if the booking is made within 21 days before arrival, unless otherwise agreed.
Contract start: from 4:00 PM.
Contract end: by 10:00 AM at the latest.

7. Tenant’s Liability

The tenant undertakes to treat the holiday property and its inventory with care and to comply with the house rules.
The tenant is liable for damages caused by themselves or their accompanying persons.
Any damage must be reported immediately, at the latest upon return of the property.
Damage discovered later may be claimed if clearly attributable to the tenant.

8. Complaints

Defects identified on site must be reported in writing to HolAp srl within 72 hours after arrival.
Damage caused by the guest must be reported in writing within 7 days after departure.
Late complaints or claims for price reduction or compensation will not be considered.

9. Events Beyond the Control of HolAp srl

HolAp srl is not liable for events beyond its control (e.g. natural disasters, strikes, political unrest, power or water outages, blocked access roads, construction noise, etc.).
In such cases, the tenant has no right to contract termination, price reduction, or compensation.

10. Liability of HolAp srl

If, for unforeseeable or unavoidable reasons (e.g. fire, water, or natural damage), the booked property is not available, HolAp srl reserves the right to offer an equivalent replacement property or to terminate the contract with a refund of payments already made.
Compensation claims are limited to the amount of the agreed rental price.
HolAp srl is not liable for damages, losses, theft, or failures of third parties.

11. Withdrawal / Cancellation by the Guest

The guest may withdraw from the rental contract at any time before arrival by written notice.
The decisive date for calculating cancellation deadlines is the receipt of the written cancellation by HolAp srl.

11.1 Cancellation Conditions for Direct Bookings

For bookings made directly through HolAp srl (website, email, telephone, or other direct channels):

  • up to 30 days before arrival: free of charge (excluding booking fee);
  • from 29 days before arrival or in case of no-show: 100% of the total price (excluding booking fee).

11.2 Bookings via Third-Party Portals

If the booking is made via a third-party portal, only the cancellation and payment conditions stated in that booking process apply.
HolAp srl has no influence over these conditions.
Any differing rules of the third-party portal take precedence over these GTC.
Payments already made will be offset against cancellation costs.

12. Re-letting / Credit

HolAp srl will endeavor to re-let the accommodation after a cancellation.
If successful, the income obtained, minus an administrative fee of EUR 100, will be credited against the cancellation costs.
The guest has no entitlement to re-letting.

13. Long-Term Stays (from 28 nights)

For stays longer than 28 nights:

  • free cancellation up to 60 days before arrival (excluding booking fee);
  • thereafter the deposit is forfeited;
  • from 30 days before arrival: 100% of the total price.
    No refund is granted in case of early departure.

 

14. No-show

If the guest does not appear without prior cancellation, this is considered a withdrawal on the day of arrival.
The full rental price remains due.

15. Price and Property Changes

Price changes and changes to the property description remain reserved, particularly in the case of adjustments to taxes, significant currency fluctuations, or similar circumstances.

16. Final Provisions

Italian law shall apply.
The place of jurisdiction is the City of Varese, to the extent permitted by law.
Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
